Dave's youngest brother Michael, married father of  three, occasionally joins his 'big bro' and Al Stewart as bass player on stage when Touring reaches the East coast. He also plays bass on CD Threads of Time, but in 'real life' he's a criminal defense lawyer.

Actually Michael is holding the office of the Federal Public Defender for the Eastern District of Virginia. Here we meet him in front of the US Supreme Court building in Washington, D.C.

He was argueing before the Supreme Court in the 'Kimbrough v. US' case on Oct 2nd, 2007, and won
the case:
The Court adjudged that federal judges are
allowed to vary sentences beyond the US Sentencing Guidelines.

This decision may affect tens of thousands of federal defendants
prosecuted and incarcerated in the US each year.
Since the Supreme Court had decided in 2005 that the
federal sentencing guidelines were not mandatory but only advisory,
federal district and appellate courts struggled to determine
just what that meant, with some judges sometimes handing out
sentences below the guidelines, which have in turn sometimes been
overturned on appeal - so it was in the case of Michael's client.

Finally on Dec 10th, the Supreme Court made the (7:2) decision on
Michael's 'Kimbrough case': In order to deal fairly with individual
circumstances, judges may impose shorter prison terms!
